Terms of Service

This Terms of Service Agreement (hereinafter — "Agreement") governs the relationship between FOP Yeryomina Maria Mykolaivna (hereinafter — "Contractor", "Lúmi Web Agency") and individuals or legal entities (hereinafter — "User") who use the website lumiwebagency.com and/or order services.

1. General provisions

Using the website constitutes the User's full and unconditional acceptance of the terms of this Agreement. If you disagree with any provision — please do not use the website.

2. Services

Lúmi Web Agency provides services in the field of website development and digital marketing, including:

  • full-cycle website development (landing pages, corporate websites, online stores);
  • SEO optimisation and website structure preparation;
  • CRM integrations, form and request automation;
  • brand identity and digital style;
  • website maintenance and technical support.

The list, cost and terms of specific services are agreed individually in writing (contract, invoice, commercial proposal).

3. Rights and obligations of the parties

3.1. The Contractor undertakes to:

  • provide services of high quality and within the agreed timeframes;
  • maintain confidentiality of information received from the User;
  • timely inform the User about the progress of work.

3.2. The User undertakes to:

  • provide accurate information necessary for service delivery;
  • timely approve work stages and make payments in accordance with the contract terms;
  • not violate Ukrainian legislation when using the developed products.

4. Intellectual property

All materials on the lumiwebagency.com website (texts, images, design, code) are intellectual property of Lúmi Web Agency and may not be copied, distributed or used without written permission.

Upon full payment for a project developed for the User — the rights to use the finished product are transferred to the User in accordance with the contract terms.

5. Payment and refunds

The cost of services and payment procedure are fixed in an individual contract or invoice. Services are provided with advance payment (full or partial, as agreed).

Refunds are only possible in cases provided for by the contract or applicable Ukrainian legislation.

6. Limitation of liability

Lúmi Web Agency is not liable for:

  • temporary unavailability of the website due to reasons beyond our control (technical failures, hosting provider actions, force majeure);
  • indirect losses, lost profits or moral damages;
  • actions of the User using products developed by us.

7. Personal data

The procedure for processing personal data is governed by a separate document — the Privacy Policy.

8. Dispute resolution

All disputes arising in connection with this Agreement are resolved through negotiation. If no agreement is reached — through judicial proceedings in accordance with Ukrainian legislation.

9. Changes to the Agreement

Lúmi Web Agency reserves the right to modify the terms of this Agreement. The new version takes effect upon publication on the website.
